    CORE BYLAW


    PART ONE
    General Provisions

    Aim and Scope
    Article 1-
    This regulation covers the organization, functions and the duties of the bodies of Izmir University of Economics established pursuant to Law Number 2547 of Higher Education and the related regulation provisions, and Law Number 4633 printed in the Official Gazette dated April 14, 2001 by the Education and Health Foundation of the Izmir Chamber of Commerce.

    Founding
    Article 2-
    This regulation is founded based on the Law Number 2547 of Higher Education, Law Number 4633 of Izmir University of Economics Founding Law, and Foundation Higher Education Institutions Regulation enacted in accordance with Law Number 2547.

    Definitions
    Article 3-
    The terms stipulated in this directive:
    Foundation refers to Education and Health Foundation of Izmir Chamber of Commerce as the Founding Foundation,
    University refers to Izmir University of Economics,
    Board of Trustees refers to Izmir University of Economics Board of Trustees,
    Senate refers to Izmir University of Economics Senate,
    Executive Board refers to Izmir University of Economics Executive Board,
    President refers to Izmir University of Economics Board of Trustees President,
    Rector refers to Izmir University of Economics Rector,
    Vice Rector refers to Izmir University of Economics Vice Rectors,
    Dean refers to Izmir University of Economics Faculty Deans,
    Director refers to Izmir University of Economics Vocational School, Institute, Research and Applied Studies Center Directors,
    Head of Department stands for Izmir University of Economics Heads of the Academic Departments,
    Secretary General refers to Izmir University of Economics Secretary General.

    PART TWO
    Board of Trustees and Its Duties

    Board of Trustees Formation
    Article 4-
    Board of Trustees, as the highest decision making body of the University, represents the legal persona of the University.

    The Board of Trustees is formed by at least 7 people who are selected by the Founding Administrative Board from among those individuals who have the specifications and qualities of being state officials, stipulated in the laws and regulations for a four-year term. At least two-thirds of the Board of Trustees members must have an undergraduate degree. Members whose term of office terminates can be re-selected. The Rector is a standing member of the Board of Trustees. There cannot be more than two people on the Board of Trustees from the Founding Foundation Administrative Board Chairman or its members or their relatives and spouses. University members other than the Rector cannot be members of the Board of Trustees.

    The Board of Trustees appoints a President for a four-year term from its members, and the President appoints a Vice-President for a four-year term.

    (Change OG 24.06.2019 / 30811) (Add OG 12/07/2013-28705) The Board of Trustees may appoint a faculty member as an advisor permanently or temporarily in order to carry out duties and responsibilities specified in article six efficiently and effectively, follow up the fulfillment of Board of Trustees decisions, ensure coordination  between Board of Trustees, and academic and administrative units in the light of priorities set by the strategic plan of the University 

    The ultimate authority of the University is the President of the Board of Trustees. The President of the Board of Trustees uses the authority given to him/her by the Board of Trustees and s/he carries out the duties assigned by this Directive and other related legislations.

    The Board of Trustees president and members who are selected or who left are reported to the Higher Education Council within one month.

    (Change: OG-18/01/2019-30659) In the case a member's term of office finishes or the member resigns for any reason, the person to replace this member continues his/her duties for four years. In order to terminate a member from the board before the end of the term of office, at least two thirds of the whole number of the Founding Foundations General Board members must vote in favor of the motion. 

    Membership on the Board of Trustees is honorary. However, with the decision of the founding Foundation Administrative Board, the right to attend the meetings, right of way and attendance fee can be given to the Board of Trustees members. The amount cannot exceed the fee stipulated for the Higher Education General Assembly members in article 6 of the law numbered 2547, and it cannot be given more than twelve times a year. No other payment will be made to the President and Members of the Board of Trustees.

    The Rector cannot be elected as the President of the Board or as the Deputy President. The Rector does not attend meetings where his appointment and personal affairs are discussed.

    The Functioning of the Board of Trustees
    Article 5-
    The Board of Trustees convenes at least once a month. The President can call the Board of Trustees to a meeting when deemed necessary.

    The quorum for meetings of the Board of Trustees is more than the half of the total number of memberships.

    The members of the Board of Trustees are entitled to give acceptance or refusal; however, they cannot abstain from voting.

    The decisions of the Board of Trustees are taken by majority of the votes cast. When there is a tie, the vote of the President is the determinant.

    The reporter of the Board of Trustees is the Secretary General.

    The Board of Trustees can delegate some of its authorities, including the representation of the University, to the President of the Board of Trustees, the Rector, or other units of the University to the extent and period it sees appropriate.

    The Board of Trustees can transfer some of its powers including representation to the President, the Rector or other bodies in the University for the period and to the extent it deems convenient.

    When the number of the members is changed or new members are elected, the President informs the Higher Education Board.


    The Duties, Authorities and the Responsibilities of the Board of Trustees
    Article 6-
    The fundamental duties, authorities and the responsibilities of the Board of Trustees are as follows:

    a) To ensure the efficient operation of the University in all respects, The Board of Trustees shapes and assesses the principles, policies and plans, which form the basis of the functioning and the administration of the University, and provides the maintenance and the perseverance of academic freedom in education, research and other academic activities.

    b) The Board of Trustees determines the status of administrative and academic duties and positions, and approves their appointments, promotions and dismissals.

    c) The Board of Trustees issues directives, bylaws and regulations about the internal operations that are prepared by the Senate, proposed by the Rector do not contradict the Core Regulations, and the Board decides on the drafts of regulations and instructions regulating the foundation and the functioning of the bodies and units of the University.

    d) The Board of Trustees makes decisions relating to the establishment, abolishment and integration of preparatory schools, vocational schools, practice and research centers, techno parks and academic units that form faculties and Vocational Schools; that will be proposed to Higher Education Council by the Rector.

    e) The Board of Trustees approves the University budget prepared by the Rectorate and accepted by the University Administrative Board, it manages all assets of the University, it monitors the applications of the University’s related departments and the investments and expenditures in construction and any kind of buying, selling, renting works in the framework of the approved budget. It accepts or rejects any donation. It tries to obtain various resources.

    f) The Board of Trustees determines the status of administrators, instructors and other personnel to be appointed in the University; makes their contracts when necessary; approves their appointments, promotions and dismissals; assesses the fees, which will be paid to the instructors and other personnel.

    g) The Board of Trustees determines the amount of fees, payment schedule and the method of collection from the students.

    h) (Change OG. 30.10.2018 / 30580)  The Board of Trustees approves the Senate proposal about the number of students and scholarship and discount quota that will be proposed to the Higher Education Council and it determines the type and amount of scholarships or discounts.

    ı) The Board of Trustees makes any decision to cooperate with higher education institutions at home and abroad, and with other institutions.

    i) The Board of Trustees gets the standards concerning the assessment and the application of the quality and the standards of education at the University.

    j) (Change OG. 30.10.2018 / 30580)  The Rector is appointed by the President upon the recommendation of the Board of Trustees, and represents the legal personality.
    k) The Board of Trustees makes the final decision in solving disputes among the various bodies of the University.

    l) The Board of Trustees performs other duties stated in the regulations related to the University.

    m) It represents the legal personality of the University.


    Presidency Council and Its Duties
    Article 6/A -
    Presidency Council, under the presidency of the Board of Trustees President is composed of two Board of Trustees Members that will be determined by the Rector, Secretary General and the President. It gathers with at least three members.

    Presidency Council carries out the duties appointed by the Board of Trustees and it informs the Board of Trustees about the results of the duties appointed to it.

    PART THREE
    The Bodies of the University

    Rector
    Article 7-
    The Rector is the primary executive body of the University.


    The Rector is appointed to a four-year term by the Board of Trustees in accordance with the recommendation of the Higher Education Council. The acting Rector may be re- appointed after the termination of his/her term of office.


    The age limit for the Rector is 67. However, the ones that were appointed before the age of 67 can carry out their duty until the end of their term of office.


    The Rector assumes the responsibility for taking the academic success of the University to the highest level. The Rector encourages administrative and academic personnel to improve the standards of education and services and to increase scientific production. His/her fundamental duty is to build a modern, creative and Liberal University.


    The Rector exerts the authorities and duties granted by the Higher Education Law numbered 2547 and Regulations for the Foundation Higher Education Institutions published on the Official Gazette dated 31.12.2005 and numbered 26040 and the authorities and the duties granted by the Board of Trustees. The Rector is responsible to the Board of Trustees concerning the improvement of the University in the future, conduct, coordination and development of current education activities. The Rector is entitled to ensure the application of the determined policies and the decisions taken by the Board of Trustees. The Rector maintains communication related to the administrative issues between the instructors and the Board of Trustees. The Rector may delegate some powers to the Vice-Rector or the Secretary General to the extent deemed convenient.


    The Rector prepares the University budget, determines the necessary personnel to be appointed to the University after taking the opinions and the recommendations of the units and the University Administrative Board, and submits them for monitoring to the Board of Trustees.


    In order to help him/her for his/her duties by taking the workload in academic, administrative and student affairs subjects into account, the Rector submits the names of at least three Vice-Rector Candidates from among the salaried professors in the University to the Board of Trustees for approval.


    In the absence of the Rector, s/he is represented by one of the Vice-Rectors and the Rector informs the President of the Board of Trustees.


    The academic and administrative personnel's leave is given by the Rector, the Rector's leave is given by the President of the Higher Education Council, and the President of the Board of Trustees is informed about this subject.

    If the term of office of the Rector is terminated and the new Rector is not appointed, the Board of Trustees assigns one of the Vice-Rectors or someone else as a Deputy Rector upon the approval of the Higher Education Council.

    Vice-Rectors
    Article 8-
    The Vice-Rectors are selected from among the instructors in the University by the Rector and appointed by the Board of Trustees.

    Secretary General
    Article 9-
    The Secretary General is the administrative chief of University personnel affiliated to the Rector except instructors and is responsible from all the administrative affairs of the University.


    The Rector proposes the appointment and the dismissal of the Secretary General and the Board of Trustees approves it.

    Senate
    Article 10-
    The University Senate is formed under the Chairmanship of the Rector by Vice-Rectors, Deans, one instructor from each faculty to be selected by the Faculty Boards for a three-year term, and Directors of Institutes and Vocational Schools affiliated with the Rector's Office. In order to expand the participation to the University’s management, the Senate may invite instructors, administrative staff and student representatives whom the Senate finds suitable, and invite their opinions.


    The Senate convenes twice a year, once at the beginning and once at the end of the academic year. The Board of Trustees or the Rector can convene the Senate for an extraordinary meeting, if necessary.

    Duties of the Senate
    Article 11-
    The Senate is an academic body of the University and is charged with the duties below:

    a) To make decisions about the education, scientific researches and publishing activities of the University, and inform the Board of Trustees about such decisions.

    b) To prepare or communicate its views on laws and regulations, bylaws and application principle drafts concerning the University, submit such drafts to the Board of Trustees for approval, and ensure that they go into effect.

    c) To review and decide on the University’s academic schedule and calendar.

    d) To determine the method of admission, quotas and conditions for all the academic programs, such as associate degree, undergraduate, graduate and post graduate degrees of the University, and to propose them to the Board of Trustees.

    e) To prepare proposals concerning the use of a foreign language besides English, or Turkish, partly or completely, in a department or a program of the University.

    f) To propose the opening of educational programs such as double major, summer schools, evening schools and adult education to propose the foundation of preparatory schools, support and continuous education units, and to determine the content and the periods of such units.

    g) To grant honorary academic titles which are not subject to examination and to make decisions about the proposals of the Faculty Boards about such matters.

    h) To examine and resolve objections to the resolutions of the Faculty Boards and the Institutes and Vocational Schools affiliated with the Rector's Office.

    ı) To elect members to the Interuniversity Board and the University Administrative Board.

    i) To do other duties stipulated in the laws, regulations and other legislation, or given by the Board of Trustees or the Rector.

    j) To make proposals to the Board of Trustees about the fees that will be taken from the students.

    k) To discuss determine the subjects about establishment, abolishment and integration of the academic units of the University and to submit to the Board of Trustees for approval.

    University Administrative Board
    Article 12-
    The University's Executive Board is formed under the Chairmanship of the Rector by Deans and three professors to be selected for four years by the Senate to represent various units and areas associated with the University.

    The Rector may convene the University Administrative Board when necessary.

    Vice-Rectors may attend Executive Board meetings without right to vote.

    Duties of the University Administrative Board
    Article 13-
    University Administrative Board is a body assisting the Rector in administrative affairs and has the following duties

    a) To assist the Rector in the execution of the resolutions of the Higher Education Supreme Councils, the Board of Trustees and the Senate, in accordance with determined plans and programs.

    b) To ensure that the activity plans and programs are put into practice; to review the investment program and the budget draft while taking the proposals of the units affiliated to the University into consideration, and to present these along with its own proposals to the Rectorate in order to be submitted to the Board of Trustees.

    c) To make decisions on topics forwarded by the Rector about the administration of the University,

    d) To examine and make conclusive decisions about objections to the resolutions of Executive Boards of Faculties, Institutes and Vocational Schools.

    e) To do other duties stipulated in the laws related to universities, or given by the Board of Trustees or the Rector.

    Deans and Directors of Institutions, Vocational Schools and Research Centers
    Article 14-
    The Rector determines Dean candidate(s) from within or outside the University having the title of professorship via a commission of “Search and Determination of Dean” which is formed by selected professors working in Turkey or abroad in the related field. The Rector submits the name of the candidate whom he sees fit, along with the commission’s opinion, to the Board of Trustees. Should the Board of Trustees approve, it appoints him as Dean for a three-year term to work full-time after taking the positive evaluation of the Higher Education Council. The Dean whose term of office terminates can be re-appointed in the same manner.


    The names of the director candidate(s) of Vocational Schools, Institutes and Research Centers determined by the Rector based on the proposal of the related faculty’s dean, and the names of the director candidate(s) of Vocational Schools, Institutes and Research Centers affiliated with the Rectorate determined directly by the Rector are submitted to the Board of Trustees. The Board of Trustees appoints the Vocational Schools, Institute and Research Center directors for a three-year term to work full-time. Vocational Schools, Institute and Research Center directors whose terms of office terminate can be re-appointed for another three-year term.


    The Dean and the directors of Vocational Schools, Institutes and Research Centers select maximum two assistants for a term of three-year among the instructors on the payroll of the University. When deans and directors are absent, one of their assistants represents them.

    Faculty Board and Faculty Executive Board
    Article 15-
    Faculty Board and Faculty Administrative Board are formed by members stipulated in the Higher Education Act, and they perform the duties stipulated in the aforementioned act.

    Heads of Department
    Article 16-
    Head of Department candidates are selected by the Deans with whom they are affiliated or by Vocational Schools directors. The Rector appoints the head of department among these candidates for a three-year term. A head of department whose term of office terminates can be re-appointed for another three-year term on each occasion.


    The head of department is responsible for the education on all levels and the researches of the department, as well as the regularity and productivity of all activities relating to the department.

    Department Board
    Article 17-
    The Department Board convenes, as a minimum, twice a year, once at the beginning and once at the end of the academic year with the invitation and under the presidency of the Head of Department. All the instructors in the department should attend these meetings.


    In the Department Board meetings, academic issues relating to the department are discussed, and proposals are prepared.

    Instructors
    Article 18-
    (Change OG. 30.10.2018 / 30580)  Duty term of the professors and associate professors is a maximum of five years and duty term of the assistant professors and other instructors is a maximum of three years.


    The selection, evaluation, assignment of the ones deemed suitable with academic titles and their promotion are made by the authorized academic organs of the University by abiding by the legislations. It is finalized with the proposal of the Rector and the approval of the Board of Trustees.


    (Change OG. 30.10.2018 / 30580)  Instructors are appointed with the motion of the dean or vocational schools director, the approval of the Rector and the decision of the Board of Trustees.

     

    (Change OG. 30.10.2018 / 30580)  Instructors are appointed in the same manner for a one-year term. Their term of duty can be extended for another year on each occasion.


    (Change OG. 30.10.2018 / 30580)  Part-time instructors’ term of duty is limited to one or two semesters.

     

    PART FOUR
    Other Provisions

    Research and Development Projects and Counseling Services
    Article 19-
    Project and counseling services demanded from the University by third parties are provided with the proposal of the related Dean/Director, the assent of the Rector and the approval of the Board of Trustees.


    Principles pertaining to the extent university personnel will benefit from the revenue they obtain from projects and consultancy services (including copyrights) shall be resolved by the Board of Trustees.

    Medium of Education
    Article 20-
    The medium of education of the University is English. All lessons are given in English, unless there is a resolution otherwise, and with the exception of the lessons, which are supposed to be given in Turkish in accordance with related law; assignments and examinations of these lessons are given in English. It can be decided with the proposal of the Senate, the decision of the Board of Trustees and the approval of the Higher Education Council that some educational units and programs are given partly or completely in Turkish or in a foreign language other than English, or those foreign languages other than English are given as compulsory lessons.

    Honorary Titles
    Article 21-
    With the proposal of the Faculty Board, the assent of the Senate, the University can give the titles of honorary associate professor or honorary professor to people with outstanding achievements in their field or valuable contributions to the quality of life in Turkey or abroad.

     

    Financial Provisions
    Article 22-
    The University's sources of revenue are as follows:

    a) Grants and donations from the Foundation,

    b) Revenues from scientific activities,

    c) Revenues from research and development projects, and counseling services,

    d) Revenues for the educational services provided,

    e) Grants from the University's budget and other public organizations and institutions,

    f) Donations, inheritances and other revenues.

    Amendments to the Core Regulations
    Article 23-
    Amendments and the addition of new articles and provisions to these Core Regulations are possible with the resolution of the Board of Trustees.

    Effectiveness
    Article 24-
    This directive takes effect on the date of its publication.

    Implementation
    Article 25-
    The President of the Board of Trustees implements the rules and regulations of these regulations.
